Elon Musk has lost his offer to block Sam Altman to turn Openai into a lucrative entity-but a federal judge signaled Tuesday that she could accelerate a trial to consider other elements of his antitrust case against the creator of chatgt.
US District Judge Yvonne Gonzalez Rogers said that Musk and his plaintiffs “had failed to fulfill their proof burden for the extraordinary relief” after they claimed they faced irreparable harm if Openai was allowed to complete a planned restructuring.
“Given the public interest in question and the potential for harm if a conversion has occurred in violation of the law, the court is ready to accelerate the trial until the fall of 2025,” Rogers wrote in its decision.
Last year, Musk’s lawsuit named Openai, Altman, Investor Microsoft, billionaire Reid Hoffman and others as co-defendants.
